% 25.07.2016 Petitioner is aggrieved by the fact that illegal and unauthorized construction has been permitted to be carried out at property bearing no. D-108, Panchsheel Enclave, New Delhi.
Status report has been filed by the respondents. Respondents submit that the said property has been booked and after inspection was carried out, a show cause notice was issued on 11.04.2016 not only to the younger brother of the petitioner (who has carried out the alleged deviations) but also to the petitioner. Further submission of counsel for the respondents is that the brother of the petitioner has filed a representation before the competent authority wherein he had
stated that the alleged deviations are protected under National Capital Territory of Delhi (Special Laws Act), 2007. This submission of the brother of the petitioner has already been considered by the Department. The same shall be answered in accordance with law and intimation of the same shall be furnished to the petitioner. This position is disputed. Petitioner submits that this protection is not available to the brother of the petitioner. This submission will be answered by the Department in accordance with law and intimation of the same shall be given to counsel for the petitioner. Let the representation of the brother of the petitioner be answered by the respondent in a time bound manner.
