The Petition under Article 226 and 227 of Constitution of India read with Section 482 Cr.P.C. /528 of the Bhartiya Nagrik Suraksha Sanhita, 2023, has been filed by the Petitioner for quashing of FIR No.683/2022 dated 25.12.2022 under Section 498/406/509/506/34 IPC registered at Police Station Ambedkar Nagar.

The facts in brief are that the marriage between Petitioner and Respondent No.2/Complaint was solemnized on 11.11.2011 according to Hindu rites and ceremonies. The Respondent No.2 after married started residing with the Petitioner at her matrimonial house in Dakshinpuri, New Delhi. the parties, the Respondent No.2/Complainant made a Complaint on which an FIR No.683/2022 was registered against the Petitioners under Section 498/406/509/506/34 IPC at Police Station Ambedkar Nagar. 3.

It is submitted that during the trial in the Court, the matter was referred to Mediation Centre, where vide Mediation Settlement dated 22.03.2025 the parties have settled their disputes amicably and they have left no grudge or grievance against each other in any manner whatsoever. As per the Settlement dated 22.03.2025 it is agreed between the parties that the Petitioner shall pay a total sum of Rs.9,00,000/- to the Respondent No.2/Complainant i.e. 1st installment of Rs.2,50,000/- shall be paid at the time of statement of First Motion of Divorce through mutual consent and 2nd installment of Rs.2,50,000/- shall be paid at the time of recording of statement of second motion Divorce through mutual consent. The third installment of Rs.4,00,000/- shall be paid in two installments of Rs.2,00,000/- each at the time of quashing of the two FIRs i.e. No.224/2018 and FIR No.683/2022. Therefore, a request is made that the FIR be quashed.

It is also stated that on 21.05.2025, the marriage between petitioner No. 1 and respondent No. 2 had been dissolved as per Hindu law. 5.

In view of the Compromise Deed dated 22.03.2025, the present petition has been filed.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. The parties have endorsed the amicable settlement and accepted the terms thereof voluntarily.

The third installment of Rs.2,00,000/- has been paid to the respondent No. 2/wife by the petitioner No. 1 today in the Court via Demand Draft No.035036 dated 25.07.2025 drawn on SBI Bank, Green Field Faridabad, and the same has been confirmed by the respondent No. 2/wife. 8.

The parties have submitted that all the disputes have been amicably settled vide Compromise Deed dated 22.03.2025 and thus, no fruitful purpose will be served in continuing with the FIR. 9.

The present petition has been signed by all the parties and is supported by their respective affidavits. The parties have reaffirmed the terms of the settlement arrived at vide Compromise Deed dated 22.03.2025 and they also submit that the said Compromise Deed has been arrived at between the parties without any pressure and coercion. 10.

Today, the complainant/respondent No. 2/wife, who is present in Court, states that she has received all amounts due to her and has no objection if the FIR is quashed.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is a family matter, I am of the opinion that no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing No. 683/2022 dated 25.12.2022 registered at Police Station Ambedkar Nagar, for offences punishable under Sections The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

498A/406/509/506/34 of the Indian Penal Code, 1860 and all consequential proceedings emanating therefrom are quashed.

The petition stands disposed of.
