The Petition under Section 482 Cr.P.C. /528 of the Bhartiya Nagrik Suraksha Sanhita, 2023, has been filed by the Petitioner for quashing of FIR No.224/2018 dated 25.05.2018 under Section 323/341/354/354(B)/506 IPC registered at Police Station Ambedkar Nagar.

The facts in brief are that the marriage between Petitioner and Respondent No.2/Complaint was solemnized on 11.11.2011 according to Hindu rites and ceremonies. The Respondent No.2 after married started residing with the Petitioner at her matrimonial house in Dakshinpuri, New Delhi. registered against the Petitioner under Section 323, 341, 354, 354B and 506 IPC at Police Station Ambedkar Nagar.

It is submitted that the Police filed the Chargesheet in the Court and during the trial, the matter was referred to Mediation Centre, where vide Mediation Settlement dated 22.03.2025 the parties have settled their disputes amicably and they have left no grudge or grievance against each other in any manner whatsoever. As per the Settlement dated 22.03.2025 it is agreed between the parties that the Petitioner shall pay a total sum of Rs.9,00,000/- to the Respondent No.2/Complainant i.e. 1st installment of Rs.2,50,000/- shall be paid at the time of statement of First Motion of Divorce through mutual consent and 2nd installment of Rs.2,50,000/- shall be paid at the time of recording of statement of second motion Divorce through mutual consent. The third installment of Rs.4,00,000/- shall be paid in two installments of Rs.2,00,000/- each at the time of quashing of the two FIRs i.e. No.224/2018 and FIR No.683/2022. Therefore, a request is made that the FIR be quashed.

The Complainant is present in the Court and submits that the matter stands settled with all the Petitioner. She has received the agreed amount of Rs.2,00,000/- today by way of Demand Draft No.035034 dated 24.07.2025 drawn on SBI Bank, Green Field Faridabad and has confirmed the same. She has no objection if the FIR is quashed against the petitioner on account of the settlement already arrived at between the parties. 5.
The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. The parties admit that the Settlement dated 22.03.2025 has been arrived at between them voluntarily without there being any pressure, force and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

In view of the submissions made, the Petition is allowed. Accordingly, the FIR bearing No.224/2018 dated 25.05.2018 registered at Police Station Ambedkar Nagar, for offences punishable under Sections 323/341/354/354(B)/506 of the Indian Penal Code, 1860 with all the subsequent proceedings and the charge sheet is hereby quashed qua the Petitioner.
