This is an Application filed by Respondent No.1 seeking disposal of the present Petition in view of the fact that the disputes in the matter have been referred to Arbitration.

Learned Counsel for the Petitioner submits that the matter is the subject matter of the arbitral proceedings. She further submits that the Petition may be disposed of extending the interim protection granted by this Court for a period of six weeks from today, to enable the Petitioner to file an appropriate Application under Section 17 of the Arbitration and Conciliation Act, 1996, before the Arbitral Tribunal.

Accordingly, with the consent of parties, the following directions are passed.
(i) The interim protection granted to the Petitioner by order dated 14.02.2017 shall remain in effect for a period of six weeks from today; (ii) The Petitioner is at liberty to move an appropriate Application under Section 17 of the Arbitration and Conciliation Act, 1996 in accordance with law.

It is made clear that this Court has not expressed any opinion on the merits of the case. All rights and contentions of the parties are left open in this regard.
