The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter "BNSS") [earlier Section 482 of the Code of Criminal Procedure, 1973 (hereinafter "CrPC")] has been filed by the petitioner praying for quashing of FIR No. 192/2025 registered at Police Station Sunlight Colony on 13.05.2025, for offences punishable under Sections 318(4)/336(2)/340(2) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter "BNS").

The dispute arises out of a matrimonial conflict between Parul Mahajan (petitioner) and her ex-husband Group Captain Manish Mahajan The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
(respondent no. 2). They married in 2005, had a son in 2008, and started living separately in 2016 due to differences. Over the years, several litigations were filed between them, including cases of cruelty, maintenance, and dowry-related disputes.

On 13.05.2025, Manish Mahajan lodged the present FIR alleging that a forged OBC certificate was fraudulently prepared in the name of their minor son by misusing his personal data, which caused him mental agony and reputational harm. According to him, neither he nor his family belonged to the OBC category, and he discovered the forged certificate while updating his Aadhaar details. He stated that the OBC certificate, falsely showing their son as belonging to the "Sunar" community, had been issued using his identity without his knowledge or consent. Manish Mahajan expressed suspicion that his Aadhaar data may have been misused by Parul Mahajan or someone on her behalf to obtain the fraudulent certificate. 4.
Learned counsel appearing on behalf of the petitioner has submitted that the petitioner and respondent no. 2 have now settled their disputes amicably and are now moving forward towards a peaceful and harmonious future.

Settlement Agreement dated 29.05.2025 is on record and has been annexed as Annexure P-2. Qua this agreement, the respondent no. 2 has agreed to withdraw the case arising out of FIR No. 192/2025 registered at Police Station Sunlight Colony against the petitioner. 6.
It is prayed by the learned counsel appearing on behalf of the parties that the instant FIR may be quashed on the basis of the compromise. 7.
Heard. Issue notice.

Learned APP for the State, who appears on advance notice, accepts notice and submits that there is no opposition to the prayer made by the petitioner seeking quashing of the FIR in question in view of the settlement arrived at between the parties.

Heard learned counsel for the parties and perused the record. 10.
The petitioner is present before this Court and has been identified by her counsel and Investigating Officer, Police Station - Sunlight Colony. Respondent no. 2 is also present in the Court and has been identified by his counsel and the Investigating Officer.

On a query made by this Court, respondent no. 2 has categorically stated that he has entered into compromise on his own free will and without any pressure. It is also stated by him that the entire dispute has been amicably settled between the parties.

Keeping in view the fact that the matter stands amicably settled between the petitioner and respondent no. 2 without any pressure, no fruitful purpose would be served by keeping the matter pending, rather the same would create further acrimony between them.

It is, thus, in the interest of justice to quash the afore-mentioned FIR and the proceedings emanating therefrom.

Hence, in light of the judgment of the Hon'ble Supreme Court passed in Gian Singh vs. State of Punjab (2012) 10 SCC 303, FIR No. 192/2025 registered at Police Station Sunlight Colony for the offences punishable under Sections 318(4)/336(2)/340(2) of the BNS, and consequent proceedings emanating therefrom, are quashed qua the present petitioner.
