By the present petition under Article 227 of the Constitution of India the petitioner seeks to challenge the order dated 31.1.2017 passed by the appellate court dismissing the injunction application of the petitioner. 2.
After some arguments learned senior counsel appearing for the petitioner submits that to amicably sort out the matter his clients would be satisfied if next election to the Governing Board of respondent No.1 are held before 30.10.2017.

Learned counsel appearing for the respondents, on instructions from Ms.Madhu Dubey, Executing Director of respondent No.1 submits that as per the Memorandum and Articles of Association of respondent No.1 they are bound to hold the next election to the governing board on or before 31.10.2017 and respondent No.1 Board would be complying with the said provisions.

In view of the above submissions made by learned counsel appearing for the respondent, the petitioner seeks to withdraw the present petition. Petition is dismissed as withdrawn accordingly. All pending applications, if any, also stand disposed of accordingly.
