This writ petition has been preferred on behalf of the Petitioners under Article 226 of the Constitution of India seeking multiple reliefs pertaining to the initial advertisement No.01/22 for filling up vacancies in the posts of Junior Engineer (Civil)/Section Officer (Civil) under the Combined Examination Scheme in different Departments such as MCD, DUSIB, DTL, DSIIDC, etc. The reliefs are claimed against Delhi Subordinate Services Selection Board (DSSSB).

From a bare reading of the petition and the reliefs claimed, it is amply clear that the remedy of the Petitioners lies before the Central Administrative Tribunal in view of Section 14 of the Administrative Tribunals Act, 1985 and the judgment of the Constitution Bench of the Supreme Court in L. Chandra Kumar v. Union of India and Others, (1997) 3 SCC 261. Section 14 of the said Act provides that save as otherwise expressly provided in the Act, the Central Administrative Tribunal shall exercise, on and from the appointed date, all the jurisdiction, powers and authority exercisable immediately before that day by all Courts (except the Supreme Court) in relation to all service matters including recruitment and matters concerning recruitment to any All India Service or to any civil service or civil post under the Union, etc.

At this stage, learned counsel for the Petitioners, on instructions, seeks to withdraw the petition with liberty to approach the Central Administrative Tribunal.

Writ petition is accordingly disposed of as withdrawn with liberty to the Petitioners to approach the appropriate Forum, in accordance with law.
