The present Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the BNSS, 2023 seeking grant of Parole for a period of four weeks for making financial arrangements for the payment of college fee for admission of his daughter. 2.

The petitioner had filed an Application for grant of Parole before the Jail Authorities on 04.06.2024, which has not been decided till date. 3.

The Status Report and the reply has been filed on behalf of the State and is taken on record wherein it is submitted that the Application has been forwarded to the Competent Authority along with the Order dated 14.08.2024 in the present Writ Petition, but because of administrative exigency no Order has been received yet.

Learned ASC for the State has further pointed out from the Nominal Roll that earlier, the petitioner had been arrested in another case in the year 2022 and has opposed the Parole.

Learned counsel for the petitioner submits that since then, two years have passed and he may be granted the benefit of Parole. The report of the Respondent confirms that the address of Petitioner as also the payment of college fee of the child has to be verified. 7.

Considering the circumstances, it is considered appropriate to grant the Parole to the petitioner for a period of four weeks. The petitioner be released on first spell of Furlough for a period of four weeks, on the following terms and conditions:

i.

The petitioner shall furnish a personal bond in the sum of Rs.10,000/- with one surety of the like amount, to the satisfaction of the Jail Superintendent.

ii.

The petitioner shall report to the SHO of the local area once a week on every Sunday between 10:00 AM to 11:00 AM during the period of furlough.

iii.

The petitioner shall furnish a telephone/mobile number to the Jail Superintendent as well as SHO of local police station, on which he can he contacted if required. The said telephone number shall be kept active and operational at all the times by the petitioner. iv.

The petitioner shall ordinarily reside at the address mentioned in the petition.

v.

Immediately upon the expiry of period of furlough, the petitioner shall surrender before the Jail Superintendent. vi.

The period of furlough shall be counted from the day when the petitioner is released from jail.

Petition accordingly disposed of.
