The present application is allowed and disposed of accordingly. Crl. A. 206/2009 In view of the foregoing, Mr. B.P. Singh, learned counsel appearing on behalf of the appellant states that in terms of the provision of Section 394

(1) of the Code of Criminal Procedure, 1973, the present appeal has finally abated on the death of the accused.
