By way of present petition filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 (hereinafter, referred to as the 'A&C Act'), the petitioner seeks appointment of an Arbitrator, to adjudicate the disputes that have arisen between the petitioners and respondent No.1 in the context of a Sublease Deed entered into between them on 15.06.2022. 3.
The petitioners claim that respondent No.1 has flouted the terms of the aforesaid Sublease Deed by not paying the subject amount. 4.
Learned counsel for respondent No.1 has drawn the attention of the Court to the previous proceedings to submit that the parties are exploring the possibility of an amicable settlement and the same has led to fruition as the settlement has been arrived at vide Memorandum of Understanding dated 12.12.2024, Clause 2 whereof provides for a payment of schedule. obligations under the MOU, having paid a sum of Rs.40,00,000/-. It is stated that the remaining sum of Rs.40,00,000/- would be paid on the dates indicated thereof.

At this stage, he submits that as the disputes have been resolved, the petition be disposed of.

Considering that there is no appearance on behalf of the petitioners and the submissions made on behalf of respondent No.1, the present petition is disposed of. However, in case the dispute subsists between the parties on account of failure of respondent No.1 to fulfill its obligations, the petitioners would be at liberty to approach the Court again.
