Learned senior counsel for accused/applicant seeks adjournment to place on record further medical documents of the accused/applicant. On 27.01.2025, it was made clear by the predecessor bench that there shall be no further extension of interim bail on medical grounds. It is informed that the interim bail is expiring today in view of the subsequent order dated 11.03.2025 of the predecessor bench.

Learned SPP on behalf of DoE does not object to adjournment but points out that as on date this application has become infructuous because it was filed on 08.03.2025, seeking six weeks interim bail on medical grounds, which period expired on 19.04.2025. It is further submitted by learned SPP that in the name of interim bail, the accused/applicant cannot be allowed to enjoy a regular bail as for more than 247 days he has been on interim bail as against custody period of 82 days.

Considering the above circumstances, the accused/applicant may file subsequent medical records if any, but looking into the medical records presently on record in the light of averments in the application and above submissions, the accused/applicant shall surrender before the concerned Jail Superintendent today itself by 08:00pm. It is specifically directed that upon surrender of the accused/applicant, he shall be provided best possible medical treatment by jail authorities, including complete medical examination and treatment at AIIMS. Medical status report from AIIMS shall be filed by the Investigating Officer.

Relist on 05.05.2025. As requested by learned senior counsel, it is made clear that on the next date, both sides shall address for interim bail on medical grounds as well as regular bail application, because according to learned senior counsel, the present application would get merged with the regular bail application in terms of Section 45 of PMLA.
