% 01.03.2017 During the course of the arguments, it is noted that an order dated 06.1.2010 had been passed by a Division Bench of this Court where WP(C) 2297/1992 also finds mention. Learned counsel for the respondent points out WP(C) 2297/1992 had died its death on 27.7.1995 (page 85 of the paper book) and this petition not having been revived how this petition came to be listed on 06.1.2010 is not clear. Submission being that an advantage which the petitioner seeks to derive out of the order dated 06.01.2010 is not available to him. Learned senior counsel for the petitioner points out that C.M. no.4978/95 had in fact been filed by the petitioner seeking a
modification of the order dated 27.7.1995 passed in WP(C) 2297/1992.
Admittedly, that application had not been disposed of. Be that as it may, learned senior counsel for the petitioner at this stage seeks permission of this Court to withdraw this petition, on the ground that there appears to be certain technical flaws in the present petition, with liberty to file a fresh petition. Permission granted.
