The present petition has been filed seeking quashing of FIR No. 229/2024 dated 17.07.2024 under Section 289, 106(1) of BNS, 2023 registered at PS Bindapur on the ground that the parties have arrived at settlement.

Mr. Ajay Vikram Singh, learned APP for the State accepts notice. 4.
The petitioners as well as respondent no. 2 (wife of deceased) are present in the Court and they have been identified by their respective counsel, as well as, by the Investigating Officer ASI Ram Singh, PS Bindapur.

Learned counsel appearing on behalf of the petitioners submits that the petitioners and respondent no.2 (wife of the deceased) have arrived at a settlement for a total compensation of sum of Rs 3,50,000/-. order dated 02.09.2025, this Court had referred to the Mediation & Conciliation Centre for the purpose of enhancement of quantum of compensation. He further submits that during the mediation, it has been agreed between the parties that the petitioner shall pay further amount of Rs 1,61,000/- beside the agreed amount of Rs 3,50,000/-, thus, making total compensation amount as Rs.5,11,000/-.

The total agreed amount of Rs 5,11,000/- has already been paid by the petitioners to respondent No.2 in the Court by way of following three demand drafts:- DD/Cheque no.

Respondent No.2 (wife of the deceased) has acknowledged having received full and final amount of Rs 5,11,000/-. 8.
On query being posed by the Court, the respondent No.2 (wife of deceased) affirms the factum of settlement and states that she does not wish to prosecute the criminal proceedings any further. 9.
In view of the fact that the parties have arrived at a settlement, no useful purpose will be served in continuing the proceedings, and it will be an exercise in futility.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 11.
Consequently, the present petition is allowed and the FIR No.229/2024 dated 17.07.2024 under Sections 289, 106(1) of BNS, 2023 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
