Pursuant to previous order, counsel for appellant has sought instructions from the appellant that he does not intend to pursue this appeal any further and is amenable to be let off for the period already undergone. 2.

Petitioner was sentenced for 5 years RI for offences punishable under Section 394/34 IPC in FIR No. 78/2018 PS Maurice Nagar and has already undergone 4 years 8 months of incarceration.

Counsel for appellant states that as per his instructions, the appellant is not opposing his conviction, and pursuing this appeal, and is amenable to being released on the sentence that is substantially over. 4.

The Court has perused the nominal roll as per which the unexpired portion is only about 31⁄2 months; the petitioner has not sought any interim bail, parole and furlough till date.

In this view of the matter, in the opinion of this Court, since the petitioner has already undergone substantial period of sentence, his sentence is reduced to the period already undergone by him. Further, fine is also reduced to Rs.5,000/-.

Petitioner be accordingly released on payment of fine. 7.

Copy of order be sent to the Jail Superintendent for information and compliance.

This appeal stands disposed of with these directions. 9.
