O R D E R

% 16.08.2024 By way of the present petition filed under section 482 of the Code of Criminal Procedure 1973 ('Cr.P.C.'), the petitioner seeks quashing of case FIR No. 181/2015 dated 01.02.2015 registered under sections 506 of the Indian Penal Code, 1860 ('IPC') and section 66A of the Information Technology Act, 2000 ('IT Act') at P.S.: Vijay Vihar, Delhi.

Pursuant to the investigation conducted in the matter, chargesheet dated 20.01.2016 and supplementary chargesheet dated 31.05.2018 have been filed in the matter; and section 66A of the IT Act has been deleted in view of the decision of the Supreme Court in Shreya Singhal vs. Union of India1.

The court is informed that the matter is now at the stage of framing of charges, which is scheduled for 19.09.2024.

Ms. Shubhi Gupta, learned APP appears for the State via videoconferencing. The complainant/Respondent No.2 is also present in person.

In the above circumstances, after making some submission, Mr. Tushar Sharma, learned counsel appearing for the petitioner seeks leave to withdraw the present petition; with liberty to pursue his remedy before the learned Trial Court at the stage of arguments on charge, seeking discharge in the matter.

The petition is accordingly disposed-of as withdrawn; with liberty as prayed for; without making any observations on the merits of the matter.
