This petition has been filed with the following prayers:- "(i) Issue a writ of mandamus directing the respondents to grant to the petitioner Disability Pension, Ex Gratia Compensation in sum of INR 20 Lakhs and arrears of Attendant Allowance and Modified Assured Career Progression Scheme as expeditiously as possible with interest @ 9% per annum from the date said benefits were due to petitioner till date of their release.

(ii) Issue a writ of mandamus directing the respondents to reinstate the petitioner in service with all consequential benefits."

In effect, the petitioner is claiming the benefit of disability pension, ex-gratia lump sum compensation and attendance allowance. We must clarify here that the plea of the petitioner was also for the arrears of financial upgradation under the Modified Assured Career Progression scheme. We have been informed by the counsel for the petitioner that the arrears thereof have been given to the petitioner on 28.08.2025. 4.

There is no dispute that the petitioner is entitled to the disability pension, ex-gratia lump sum compensation and attendance allowance. 5.

The only submission made by the counsel for the respondents is that the proposal is pending before the Ministry of Home Affairs. 6.

If that be so, we grant eight weeks time to the respondents to release the aforesaid benefits with the interest @ 9% p.a. from the date of entitlement/retirement. In the eventuality, the benefits are not released to the petitioner within eight weeks, interest shall be paid @ 12% p.a. 7.

The petition is, accordingly, disposed of.
