This petition is filed seeking quashing of FIR No. 30/2023 under Sections 279/3381PC PS Hazarat Nizamudin basis settlement arrived at between the parties before the Mediation Centre, Saket Courts, Delhi which is on record of this Court.

As per settlement an amount of Rs.50,000/- was to be paid which has been paid by respondent no.2-complainant, who is present in the Court and acknowledges the same and states that he has no objection to quashing of the FIR.

APP for the State submits that charges have been framed and there were multiple injuries in the said accident. However, counsel for respondent no.2, on instructions, states that respondent no.2 has chosen to settle the matter under no pressure or coercion.

Petitioner is also present in the Court, duly identified by the IO and his counsel.

Considering the above settlement between the parties and the chances of conviction of the petitioner being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No. 30/2023 under Sections 279/3381PC PS Hazarat Nizamudin, Delhi and proceedings emanating therefrom are quashed.

Parties shall abide by the terms of settlement. 7.
Accordingly, the petition is disposed of along with the pending application.
