O R D E R

% 25.02.2020 The present petition has been filed by petitioner for grant of anticipatory bail in FIR No.29/2018 dated 17.1.2018 registered at Police Station Amar Colony, Delhi.

Case of prosecution is that petitioner was working in Accounts department since 3.10.2017. On 15.11.2017 at around 3 pm, he left office without any information and took along with him company's assets like laptop, diary, I card, mouse and some other accounts related documents. Whereas, case of petitioner is that his salary of 13 days was due with complainant and when he contacted complainant, who abused him. Accordingly, he sent a WhatsApp message to complainant, "Bloody Cheap & Bastard, I left 13 days of Salary. This amount is gift for your Sister on behalf of me & add this amount in her dowry." Due to which, aforesaid FIR was registered on false allegations.

However, keeping in view facts and circumstances of case, this Court is of the considered view that the present case is fit for anticipatory bail.

SHO/ Arresting Officer/IO concerned, is hereby directed that in the event of arrest, petitioner/ applicant shall be released on bail on following terms and conditions:- (i) Petitioner shall furnish a personal bond in the sum of ₹15,000/- with one surety in the like amount subject to the satisfaction of Arresting Officer/SHO/IO concerned;

(ii) Petitioner shall cooperate with the investigation and make himself available for interrogation by police officer, as and when required; In case of default of aforementioned conditions, the State is at liberty to take appropriate recourse in accordance with law. Before parting with the order, it is relevant to mention that nothing contained in this order shall be construed as an expression on the merits of the case.

Petition stands allowed and disposed of.

Order dasti under signatures of the Court Master. Copy of this order be transmitted to SHO/IO concerned for necessary compliance.
