This is an Application seeking refund of Court fee. 2.

Learned Counsel for the Appellant contends that the Court fee in the sum of Rs.88,047/- was filed alongwith the Appeal, however, on the first date itself, the Appeal was withdrawn by the Appellant seeking liberty to file appropriate proceedings.

Learned Counsel for the Appellant thus submits that to enable the Appellant to file fresh proceedings, the Court fee may be permitted to the withdrawn.

In view of the above, let Court fee in the sum of Rs.88,047/- be refunded to the Appellant by the Registry of this Court within a period of two weeks.

The Application is disposed of.
