Mr. Mohan, learned senior counsel for the petitioner on instructions states that the appellant be permitted to withdraw the present appeal with liberty to invoke the arbitration clause contained in the Escrow Agreement dated 09.12.2013 as well as the Substitution Agreement dated 09.12.2013.

Additionally, he also seeks liberty to request for constitution of the same Arbitral Tribunal seized of the disputes of "Rohtak Hissar Tollway Private Limited & Anr. v. NHAI" in order to avoid conflicting decisions.

Granting the said liberty, the appeal is dismissed as withdrawn. 4.

The Court has not adjudicated the present matter upon any rights of any of the respondents to oppose the appellant taking action as per law.
