The Petitioner has filed the instant petition, alleging contempt of the order dated 15th March, 2019, passed by this Court in CRL.M.C. 2436/2018, which reads as follows:

"1. Rejoinder has not been filed. Let the same be filed within four weeks.

2. Learned counsel for the petitioner submitted that the petitioner is ready and willing to pay to his son 50 per cent of the amount of the arrears in terms of the order of the Trial Court and shall bring a demand draft in the name of the child of the parties, namely, Master Tejas Trivedi for the said purpose in the Court on the next date of hearing.

3. The respondent shall remain present in the Court on the next date of hearing.

4. Renotify on 23.8.2019."

In the aforenoted order, the Petitioner had expressed his willingness to pay his son 50% of the amount of arrears in terms of the order of the Trial Court.

contempt of this Court's order. On this issue, Mr. Trivedi, the Petitioner appearing through video conferencing, contends that the Respondent could not have initiated execution proceedings against the Petitioner, and that the institution of such proceedings amounts to an act of contempt. 4.

The Court, however, is not convinced by the submissions advanced by Mr. Trivedi. It is observed that no stay was granted by this Court restraining the filing of execution proceedings. Therefore, there is no reason as to why the filing of execution petition would amount to contempt of the aforesaid order.
