Present writ petition has been filed challenging the order dated 31st May, 2024 passed by the Debt Recovery Appellate Tribunal ("DRAT") in Appeal No. 160/ 2024 whereby an interim order was declined to the petitioner. The petitioner also seeks directions to respondent No.2 to not alienate, transfer or encumber the subject property until the disposal of the proceedings pending before the DRAT.

On 09th September, 2024, this Court had directed that till the next date of hearing, the parties shall maintain status quo with regard to possession and title of the property in question.

Mr. Mehra, learned senior counsel for respondent No.2 prays that as the matter is pending before the DRAT, the present petition be disposed of with a direction to the DRAT to decide the matter expeditiously, in accordance with law.

Learned counsel for the petitioner is agreeable to the same provided the interim order dated 09th September, 2024 passed by this Court continues to operate till the disposal of the appeal by the DRAT. Mr. Mehra has no objection to the same.

Accordingly, with the consent of the parties, the present writ petition is disposed of with a direction to the DRAT to decide the petitioner's appeal being Appeal No. 160 of 2024 arising out of Transfer Appeal No. 1/2022 in accordance with law as expeditiously as possible. Till the disposal of the said appeal, the interim protection granted by this Court vide order dated 09th September, 2024 shall continue to operate. The rights and contentions of all the parties are left open.
