By way of the present writ petition filed under Section 226 of the Constitution of India read with Section 528 of the BNSS, 2023, the petitioner seeks following prayers :- "i. Issue a writ in the nature of Quo Warranto or any other appropriate writ/s, order/s, direction/s FOR Quashing the Notice dated 25.07.2024, and the proceedings emanating therefrom ii. Direct the Respondent No.4/DCP South East to initiate appropriate Action as per law against the Respondent No.2/SI Inderjeet and Respondent No.3/SHO Okhla Industrial Area PS/ Sh. Sukhvir Singh."

In support of prayer (1), ld. counsel for the petitioner contends that there was no prior complaint against the petitioner. Issue notice.

Mr. Bhandari, ld. ASC for the State accepts notice and opposes the present petition. He submits that prayer (1) has become infructuous, inasmuch as, FIR No. 607/2024 under Sections 354/509 IPC stands registered against the petitioner at P.S. Okhla Industrial Area. Insofar as, prayer (2) is concerned, he submits that the complaint against the present petitioner was received on 22.07.2024 and the reference of complaint is already mentioned in the notice issued.

In view of the above, the present petition alongwith pending applications is dismissed as infructuous.
