O R D E R

The present proceedings are instituted under Section 528 of BNSS, 2023 on behalf of the petitioners seeking quashing of FIR No. 260/2022 registered under Sections 452/353/186/120-B/34 IPC at P.S. Sector 23, Dwarka, Delhi on the ground that the parties have amicably settled their disputes.

The present FIR came to be registered on the complaint of respondent No.2 over a family dispute in respect of a property. 3.

Mr. Lao, learned Standing Counsel for the State, on instructions, submits that apart from present petitioners, there are five more accused persons who have not approached this Court in the present petition. He, on instructions, submits that investigation is pending in the present FIR and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Ld. counsel for the petitioners, on instructions, submits that the other five accused persons are not related to respondent No.2 thus, their whereabouts are not known to them. He further submits that the present settlement has been arrived vide MOU/Settlement Agreement dated 29.07.2024 between the present petitioners and respondent No.2 only. 5.

Petitioners and respondent No.2, who are present in Court, have been identified by their respective counsels as well as the I.O./ASI Vinay Kumar, P.S. Sector 23, Dwarka, Delhi. Petitioners have shown remorse for their conduct and undertake not to repeat the same in future. 6.

Respondent No. 2 states that she has entered into the settlement with the present petitioners out of her own free will, volition and without any coercion. She further states that she has no objection if the present FIR and consequent proceedings are quashed against the present petitioners and even against those who have not been made party.

The parties shall remain bound by the statements made in Court today.

In view of the above facts and considering that no useful purpose will be served in continuance of the proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed against the present petitioners only.

With the above directions, the petition is disposed of alongwith pending application.
