The present petition under Section 25B(8) of the Delhi Rent Control Act, 1958, read with Section 151 of the CPC seeks the following prayers: - "a). Set aside the impugned order dated 21/12/ 2024 passed by the Ld.Senior Civil Judge-CUM-Rent Controller, South District, Saket Courts, New Delhi, in the case title Shri Ram Prakash V s Shri Sher Singh vide case No. RC ARC-29/23 on the grounds of bonafide requirements, b). Call the records of the Ld. Trial Court of the above noted case and examine the legality of the impugned order dated 21.12.2024 and grant reasonable time to the petitioner for other accommodation not less then 2-years to shift his Shop from the Suit Property on the event of eviction.

c). pass any other order in favour of petitioner/revisionist and against the respondent herein which this Hon'ble Court deems fit and proper, in the light of above-mentioned facts and circumstances, in the interest of justice."

Vide order dated 30.07.2025, learned Predecessor Bench of this Court had issued notice in the present petition by observing as under: - "2. After making some submissions, Mr. Romil Pathak, leamed counsel appearing for the petitioner submits that, the petitioner would be willing to vacate the subject premises if given reasonable period of time to vacate; and would also be willing to pay reasonable use and occupation charges in the meantime, as may be agreeable between the parties.

3. Issue notice, limited only to the time that the petitioner would take to vacate the subject premises; and the use and occupation charges they would pay in the interregnum."

Learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition.
