The present writ petition has been filed seeking to remove dead and dangerous trees standing on the land in front of the petitioner's house i.e. B245/1, Derawal Nagar, Delhi-110009. 2.

The status report filed on behalf of respondent-MCD is handed over in Court and the same is taken on record. It is stated in the status report that pruning was carried out by MCD in order to remove overgrown branches and maintain public safety.

In the status report filed on behalf of respondent no.2/Deputy Conservator of Forests (North) on 16th September, 2025, it is stated that there are two trees in front of the petitioner's house: (i) one Palm Tree and (ii) one Neem Tree.

Insofar the Neem tree is concerned, the stand taken in the status report of respondent no.2 is that it appears to be green. 5.

It is an admitted position that the Palm Treen was completely dry and fell down in March 2026.

The petitioner, who appears in-person, submits that even though the Neem Tree is green, it is tilting towards the petitioner's house and may fall down.

Accordingly, a direction is issued to respondent no.2/Deputy Conservator of Forests (North) to carry out the inspection of the aforesaid Neem tree and to assess whether the same is tilting and is likely to fall and cause damage to the petitioner's property.

In the event the aforesaid Neem Tree is found to be tilted and likely to fall, the concerned officer of respondent no.2/Deputy Conservator of Forests (North) will inform the respondent-MCD and MCD shall take action in accordance with law for removal for the said Neem Tree. 9.

The petitioner submits that he shall plant five (5) other trees in the area in view of the aforesaid tree being removed. 10.
