The present writ petition has been filed seeking directions to the respondent no.1 with respect to the unauthorised construction being carried out in the property bearing no. X/3126, Gali No. 4, Raghubarpura No. 2, Gandhi Nagar, Delhi-110031, measuring 100 sq. yds. 2.

Counsel appearing for the petitioner submits that the respondent no.2, who is the owner of the property in question, has started raising unauthorised commercial construction, without obtaining any sanctioned building plan approved from the Municipal Corporation of Delhi (MCD). 3.

It is submitted that the house of the petitioner is situated adjacent to the property in question, where the illegal construction is being carried out. stated that the subject property was inspected on 28th August, 2025 and it was noted that the owner of the subject property had initiated steps to carry out construction and building material was found at the site. Accordingly, a work stop notice has been issued on 28th August, 2025, to the owner/occupier of the building and a copy thereof endorsed to the SHO, P.S. Gandhi Nagar. In view thereof, no further orders are required to be passed in the present writ petition and the same is disposed of accordingly. 4.

Consequently, all pending application(s) are disposed of. 5.

In the event the petitioner has any further grievance with regard to unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.

Needless to state, all rights, contentions and legal remedies of the owner/occupier/private respondent shall remain protected.
