Mr. Zoheb Hossain, learned counsel appearing for the Directorate of Enforcement ['ED'] has placed on record the following communication, which has been received from the ED:

"Please refer to the trail email. operate the bank a/c and renew & reinvest the Demat a/c subject to maintaining the balance as on the date of attachment, the only condition imposed by this Hon'ble Court vide the order is that a prior intimation may be sent to ED.

Since this Hon'ble Court has already permitted to renew and reinvest the securities, with a prior intimation to the ED, (such intimation already is already sent by the petitioner to ED). There remains no action to be taken on behalf of ED, therefore, Hon'ble Court may pass appropriate orders to the bank, safeguarding interest of ED."

A perusal of the above shows that ED, which is the main contesting respondent, does not have any objection regarding the operation/renewal/reinvestment of the Demat A/C, by the petitioner subject to conditions already imposed by the Court. His statement is taken on record. Therefore, the petitioner is granted liberty to approach the concerned bank who in turn, are also under an obligation to act as per directions passed by the Court.

With the aforesaid observations, the petition stands disposed of.
