Petitioners seek quashing of FIR No.96/2024 of PS Kalkaji for offence under Section 377/498A/406/34 IPC on the ground that complainant de facto (respondent no.2) has settled the disputes with the petitioners. 2.

Learned ASC accepts notice and submits that State has serious objections to this petition.

In paragraphs 9-10 of the FIR, the respondent no.2 has alleged that her husband and mother-in-law did not want her to give birth to a child, so they made her consume certain tablets with milk which caused miscarriage without her consent. That, prima facie would be an offence under Section 313 IPC and learned ASC submits that the Investigating Officer needs to continue further investigation to file a chargesheet. 4.

Under these circumstances, learned counsel for petitioners seeks permission to withdraw this petition. Accordingly, the petition and pending application are dismissed as withdrawn.
