Vide order dated 03.12.2025, the Hon'ble Court has, inter alia, directed as under:- ".....
15. The learned counsel for the applicant has further submitted that the applicant has no objection if the sum of Rs.1,00,000/- deposited with the Registrar General of this Court is also released in favour of the complainant.
16. Considering the aforesaid, the Registry of this Court is directed to release the sum of Rs.1,00,000/- in favour of the complainant on the complainant furnishing an undertaking in the form of an affidavit that in case the applicant succeeds in the present case, the entire amount of Rs.5,00,000/- would be refunded forthwith to the applicant. ....."

case in the form of FDR and the demand draft for remaining sum of ₹1,00,000/- is stated to be returned by the concerned bank on account of "drawer signatures required".

Learned counsel for the complainant submitted that complainant has filed the requisite undertaking in the form of an affidavit in compliance of the aforesaid order passed by the Hon'ble Court. She further submitted that as of now, sum of ₹4,00,000/- may be released to the complainant and for the remaining amount of ₹1,00,000/-, a notice may be issued to the applicant/accused to deposit the said amount in the registry. 4.
Complainant is present before this court, whose separate statement has been recorded qua the release of the aforesaid amount as well as his undertaking to return the same in case applicant succeeds in the case. He has also been identified by the concerned SI Harish Kumar as well as by his counsel.

In view of the above, Registrar (B&C) is directed to remit the amount of the ₹4,00,000/- to the bank account of the complainant, the details of which are provided in the form of cancelled cheque placed on record by the complainant, in terms of the aforesaid order passed by the Hon'ble Court after due verification.

Further, the registry is directed to issue court notice to the applicant/accused as well as his learned counsel qua the return of the demand draft of ₹1,00,000/- and to deposit the said amount with the registry, for 20.02.2026.
