O R D E R

% 12.03.2026 CONT.CAS(C) 710/2006 1.

This is a contempt petition seeking contempt for violation of the directions of this Court passed vide order dated 16.09.2004 in W.P. (C) 5279/1999.

The said writ petition was disposed of with the following directions : "8. Writ petition is accordingly disposed of with the following directions:- a) A mandamus is issued to the concerned authority be it DDA or MCD, which issue would be decided inter se the two parties, to metal the site of the road from where encroachments have been removed. Needful be done within 6 months from the date of receipt of this order. b) Any road which abuts the colony Sawan Park which is under encroachment would be made free from encroachments and the site would be metaled to restore the strip of land to a road.

c) If the sanctioned lay out plan of the colony shows that a storm water drain has to be erected, site of encroachment where storm water drain has to be laid, would be made free from encroachments and a storm water drain would be laid, preferably within a period of 6 months from today and in any case not later than 1 year from the date of receipt of the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The directions contained in clause (a) of paragraph 8 of the said order, has already been complied with.

As regards the clause (b) of paragraph 8, it is directed that the encroachment of jhuggi dwellers shall be removed once the entitlement of the jhuggi dwellers in decided in accordance with DUSIB policy. 5.

As regards to clause (c) is concerned, the affidavit of DDA as well as MCD shows that at the time of Commonwealth Games in 2010, a railway under-bridge was constructed and both DDA and MCD are of the opinion that a Storm Water Drain is no longer needed. Hence, the direction C has also been complied with.

In this view of the matter, the contempt petition is disposed of. W.P.(C) 13721/2023 & W.P.(C) 18923/2025 7.
