% 15.01.2020 W.P.(C) 569/2020,CM APPL. 1540-1542/2020 The petitioner is aggrieved of order dated 24.09.2019 passed by the respondent, whereby, the petitioner was put under deemed suspension w.e.f. 11.06.2019 to 21.07.2019 and placed under suspension with immediate effect in terms of sub-rule (1) of Rule 10 of the CCS (CCA) Rules, 1965. The other grievance of the petitioner is with regard to the admissible subsistence allowance having been not paid inspite of the orders passed in the same order. Challenge to the suspension order, if, the petitioner has any valid reason can be made before the CAT inasmuch as said subject matter falls within the domain of CAT. This court therefore refrains to adjudicate on any of the allegations made in the petition. It however goes without saying that admissible subsistence allowance must be paid to the petitioner if not already paid.
In view of the foregoing, the petition alongwith CM APPLs. 154042/2020 is disposed of accordingly. The admissible subsistence allowance of the petitioner, if already not paid, shall be released within 10 days.
