This hearing has been done through hybrid mode. 2.

The present petition has been filed by the PetitionerBaatr Ulyumdzhiev under Articles 226 and 227 of the Constitution of India, inter alia, seeking permission to re-export the two gold bars of the Petitioner, collectively weighing 100 grams. The said gold bars were seized from the Petitioner on 21st May, 2024 vide detention receipt bearing no. 35791 dated 21st May, 2024 (New detention receipt bearing no. 36407 dated 14th January, 2025).

The case of the Petitioner is that he was travelling from Russia to New Delhi on 21st May, 2024. Upon arrival at the Indira Gandhi International Airport, New Delhi, the Petitioner was intercepted by the concerned officials of the Customs Department and the said gold bars were detained by the Customs Department. The Petitioner claims to be a Buddhist Monk. The The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Petitioner is willing to re-export the goods and prays that he may be permitted to do so without fine and penalty.

In this matter the Order-in-Original dated 12th March, 2025 has already been passed as per which the Petitioner has been given the option to redeem the gold bars subject to payment of fine of Rs. 80,000/- and a penalty of Rs.67,000/-.

Ld. Counsel for the Petitioner submits that the Petitioner is also willing to abide by the said Order-in-Original as well. 6.

However, Ms. Benjamin, ld. SSC appearing for the Respondent submits that the Customs Department has already filed an appeal against the said Order-in-Original dated 12th March, 2025 which is now pending before the Commissioner (Appeals).

Accordingly, let the Petitioner appear before the said Commissioner (Appeals) on 27th August, 2025 at 11:30 A.M., after which the Commissioner Appeals shall pass an order by 30th September, 2025 in accordance with law.
