O R D E R

% 06.02.2020 The present criminal contempt petition under Section 10 and 11 read with 2(b) of the Contempt of Courts Act, 1971, instituted on behalf of the petitioner, prays as follows:- "It is, therefore, most respectfully prayed that this Hon'ble Court may be pleased to:- a) initiate contempt proceeding against the contemnors/respondents No. 1 and 2 under the Contempt of Courts Act 1971 for willful disobedience, violation and breach of undertaking dated 13.07.2019 in CC No. 11188 titled as SABMiller India Limited Vs. M/s Chill Out Departmental Store passed by the National Lok Adalat: b) direct the contemnors/respondents NO. 1 and 2 to comply with the undertaking/order dated 13.07.2019 passed by the concerned Court;

c) pass such other order(s) in the circumstances of the case as this Hon'ble Court may deem fit and proper be also passed in favour of the petitioner and against the contemnors/respondents."

After some arguments, learned counsel appearing on behalf of the petitioner, seeks leave to withdraw this criminal contempt petition with liberty to approach the Court of competent jurisdiction in this behalf, in the first instance.

Leave and liberty granted.
