O R D E R

% 30.11.2018 There is no appearance on behalf of the appellant on the matter being called out. In the report earlier received from the Superintendent Jail, it was noted in the proceedings recorded on 15.06.2018 that he had been released after expiry of the period of sentence, he having deposited the amount of fine on 20.06.2007.

The appeal is dismissed following the ruling of the division bench of this court in Mukesh vs. State, 2008 SCC Online Del 877; and Kamlesh vs. State, 2009 SCC Online Del 3729.

The trial court shall re-confirm if the appellant had undergone sentence in this case and take necessary measures in light of the findings reached.

Registry is directed to send a copy of this order to the concerned trial court.
