The petitioner has filed the present application praying that he be released on bail in connection with FIR No. 410/2017, under Section 20 of the Narcotics Drugs Substances Act, 1985 (NDPS Act), registered with Police Station New Ashok Nagar.

The said FIR was registered on 03.08.2017. It is alleged that the petitioner and his co-accused-S. Ganesh, were found carrying three gunny bags. The petitioner was carrying one gunny bag which allegedly contained five packets of contraband, weighing 9.5 kgs in aggregate. The co-accused was allegedly found carrying two bags containing 11.7 kgs and 9.5 kgs of contraband.

The learned counsel appearing for the petitioner submits that by an order dated 12.09.2019, in Bail Application No.1423/2019, captioned S. Ganesh v. The State, the petitioner's co-accused, was released on bail. He

submits that on the principle of parity, the petitioner ought to be released on bail as well. The aforesaid contention is merited. 4.

Accordingly, the application is allowed and the petitioner (Ram Pravesh Prasad) is directed to be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the equivalent amount to the satisfaction of the Trial Court. This is also subject to the following further conditions:- (a) The petitioner shall ensure that he appears before the Trial Court on all the dates of hearings; (b) The petitioner shall not leave the National Capital Territory of Delhi without approval of the Trial Court; (c) He shall mark his presence with concerned Police Station (having jurisdiction, where he resides) on the first Monday of each calendar month;

(d) This is also subject to the petitioner's address being verified.

The petition is allowed in the aforesaid terms. 6.
