This application has been filed seeking anticipatory bail in FIR 461/2024 under Section 318(4)/336(3)/340(2)/ 61(2) BNS & 12 PP Act. 2.

The FIR was registered on basis of a fake Canadian Visa being found on passport of one Karminder Singh who was travelling to Vietnam and was thereafter deported. Though the Vietnamese Visa was genuine, Canadian visa on passport was found to be fake. Pursuant to investigation a number of accused have been arrayed including Gurnam Singh, Jaggi @ Jagjit Singh, Rakesh Kumar, Honey and Manjit Bawa.

Counsel for petitioner states that the petitioner had no role in matter, except at best that he had introduced agent Gurnam Singh, who is already on regular bail by order dated 9th August 2024. Further, Rakesh Kumar, and Manjit Bawa have also been granted anticipatory bail. Also that Karminder Singh never used the visa and travelled to Canada. Petitioner was granted interim protection by orders dated 19th July, 2024, 22nd July, 2024, 30th July, 2024, and 5th August 2024, however is rejected by order dated 9th August 2024.

Subsequently, a Status Report has been filed according to which the investigation is complete and the chargesheet has been filed before the Trial Court on 29th August, 2024.

In these circumstances, petition is allowed.

In light of the above, the Court is of the considered opinion that the petitioner is entitled to anticipatory bail. Consequently, in the event of arrest the petitioner be released on bail on furnishing a personal bond in the sum of Rs. 25, 000/- with one surety of the like amount subject to the satisfaction of the arresting officer/IO/SHO concerned, further subject to the condition that the petitioner will join investigation as and when directed and not influence any witness/complainant/victim or tamper with evidence of the case. 8.

Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
