BAIL APPLN.405/2016 Apprehending her arrest, the present application under Section 438 of Cr.PC has been moved by the petitioner, who is mother-in-law of the complainant, for grant of anticipatory bail in case FIR No. 0827/2015 under Sections 498A/406/34 IPC registered at Police Station Roop Nagar, Delhi.

Ms Neelam Sharma, Additional Public Prosecutor for the State accepts notice and at the outset it is submitted by her that so far no permission for arrest of the petitioner has been obtained from the competent authority.
In view of these submissions, the application is premature and is accordingly dismissed. It is, however, made clear that in case of any such permission for arrest of the petitioner is obtained, in that case, five working days notice shall be served upon the petitioner.
