The present petition under Section 25B(8) of the Delhi Rent Control Act, 1958, seeks the following prayers:- "a) Call for the records of the - Eviction Petition no. E-740/2017 (CIS No. 850/17) titled as ''Mohd. Yaqub V/s Mohd. Wasim"; b) Set aside the Impugned Judgment/Order dated 18.09.2019, passed by Ms. Susheel Bala Dagar, CCJ-cum-ARC, Central Distt., Tis Hazari Courts, Delhi and further be pleased to pass, an eviction order against the Respondent ' and in favour of the Petitioner; in the interest of justice.

c) grant any other order(s) which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case. It is prayed accordingly."

Learned counsel for the petitioner/landlord submits that, during the pendency of the present proceedings, an oral settlement/agreement has been arrived at between the parties.

Mohd. Wasim, respondent-tenant, is present in Court today and does not dispute the aforesaid fact.

It is orally agreed between the parties that the petitioner will pay the respondent a sum of Rs. 2.5 Lakhs within a period of two months from today and on such payment being made, respondent shall vacate the subject premises within the aforesaid period.

In view of the aforesaid settlement, learned counsel for the petitioner seeks leave to withdraw the present petition. 7.

The present petition is dismissed as withdrawn and disposed of. 8.
