The point involved in the present contempt petition is very short and precise.

In terms of the order and judgment dated 09.10.2023 passed by learned Division Bench of this Court in W.P.(C) 5052/2023, while allowing the writ petition filed by the petitioner herein, the respondent was directed to return the seized articles as well as the money which had been deposited by the petitioner.

The above said order is dated 09.10.2023 and, undoubtedly, the considerable period has already elapsed and there is no compliance of the above said order.

Sh. Anurag Ojha, learned Standing Counsel for the respondent submits that the Department was earlier contemplating filing of Special Leave Petition. However, at the same time, he states that if they fail to obtain any relief from the Hon'ble Supreme Court within a period of CONT.CAS(C) 1840/2023 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. four weeks from today, they would ensure that the above said order is complied with and the seized articles and the money are duly returned to the petitioner.

Learned counsel for the petitioner submits that in view of the above said assurance given by Sh. Ojha, learned counsel for the respondent, at the moment, the petitioner does not press his petition. However, he states that in case nothing happens even after the expiry of the period of four weeks, the petitioner may be granted liberty to revive the present contempt petition.

In view of the above said assurance given by Sh. Ojha, learned counsel for the respondent, the contempt petition stands disposed of as not pressed. Liberty, as prayed, is granted.
