The petitioner has assailed dismissal of execution proceedings. The execution proceedings were dismissed on the ground that the judgment debtors are located in England and Hong Kong and they do not have any assets in India.

Learned counsel for petitioner seeks permission to withdraw this petition with liberty to file fresh execution proceedings before the trial court as and when any asset is acquired by judgment debtors in India. 3.

Accordingly, the petition is dismissed as withdrawn with liberty as sought.
