The applicant, Ms. Sujata Mehta, seeks impleadment in the petition on the ground that she has purchased the subject property [Flat No. 572, Mandakini Enclave, Alaknanda, New Delhi-110019] from the erstwhile owner, who was impleaded as respondent No. 7. 2.

With the consent of learned counsel for the parties, the application is allowed and the applicant is impleaded as respondent No. 8 in the writ petition.

alleged unauthorised construction and encroachment in Flat No. 572, Ground Floor, SFS Flats, Mandakini Enclave, Greater Kailash, New Delhi-110019.

Mr. Tushar Sannu, learned counsel for the Municipal Corporation of Delhi ["MCD"], states that unauthorised construction was found in the premises but has been removed, as stated in the affidavit filed by MCD on 10.01.2024.

Mr. Sannu further states that an inspection will be carried out again within one week and if any unauthorised construction or encroachment is found, action will be taken expeditiously in accordance with law. 4.

Ms. Mansi Sood, learned counsel for respondent No. 8, states that respondent No. 8 has not raised any construction in the building and that she undertakes to remove any unauthorised construction or encroachment outside the flat, subject to permissible regularisation. 5.

In view of the aforesaid submission, Mr. Digvijay Prasad, learned counsel for the petitioner, does not seek any further orders in this writ petition, which stands disposed of.

The aforesaid submissions are recorded without prejudice to the rights and contentions of the owners of the subject property, whose remedies are expressly reserved. MCD is directed to take action strictly in accordance with law, and after complying with all statutory requirements.
