This petition has been filed seeking anticipatory bail in FIR no. 177/2024 PS Chanakyapuri Delhi under Sections 27/61/85 of NDPS Act. 2.
Pursuant to the previous order dated 20th August, 2024, the petitioners have moved for cancellation of the NBW's which have since been cancelled by Trial Court on 19th September, 2024. As per the case of the prosecution, one Maneesh@Sonu was apprehended smoking smack on 26th April, 2024, and an FIR was registered basis disclosure on 06th June, 2024. A raid was conducted at the house of the applicant but nothing incriminating was recovered. 4.
Later, it transpired that both the accused are BC of the area. On 08th June, 2021 notice under Section 67 of NDPS was sent but the door was found closed. This was followed by another notice under Section 67 of NDPS Act. Accordingly, NBWs have been issued and now stand cancelled. 5.
Pursuant to the previous order dated 23.09.2024, both the petitioners have joined the investigation as is confirmed by the IO, who is present in Court.

Counsel for the petitioner, on instructions, states that the petitioners shall continue to join and co-operate in the investigation. It is noted that there is no incriminating seizure made from the petitioners. The Court on 15.05.2024 had issued notice and on 05.07.2024 had granted interim protection to the petitioners.

Accordingly, the petitioners are hereby granted anticipatory bail in FIR no. 177/2024 PS Chanakyapuri Delhi under Section 27/61/85 of NDPS Act. Consequently, in the event of arrest the petitioners be released on bail on furnishing a personal bond in the sum of Rs. 25,000/- with one surety of the like amount subject to the satisfaction of the arresting officer/IO/SHO concerned, further subject to the condition that the petitioner will join investigation as and when directed and not influence any witness/complainant/victim or tamper with evidence of the case. 8.
Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
