This application has been filed by the Parokar of the appellant, inter-alia, asserting that the appellant, Santosh Kumar, has passed away on 15.03.2023.

The Additional Public Prosecutor, on instructions, submits that the concerned investigating officer has verified the factum of his death and has learnt that Santosh Kumar has indeed passed away. 3.

In view of the aforesaid, the appeal is disposed of as having abated. 4.

Needless to observe that if the Investigating Officer gets an information or documentary evidence indicating that the above recorded information about the death of the appellant to be incorrect, he will be free to move an application for revival of the appeal in accordance with law.
