The present petition under Section 25-B(8) of the Delhi Rent Control Act seeks following prayers:- "In view of the aforesaid facts and circumstances, it is, therefore, most respectfully and humbly prayed that this Hon 'ble Court may kindly be pleased to set-aside the impugned order dated 29.03.2025 passed by Sh. Mohit Sharma, SCJ cum RC (South East), Saket Courts, New Delhi, in the eviction petition No. RC/ARC -14/2024, titled as "Somendra Koli Vs. Dev Raj", in the interest of justice.
Any other or further order (s) which this Hon'ble Court deem fit, just and proper under the facts and circumstances of the case, may also be passed in favour of the Petitioner and against the Respondent, in the interest of justice."

On 22.04.2026 this Court had passed the following order:- "2. Learned counsel for the petitioner, on instruction from the latter, who is present in Court today, submits that the latter shall vacate the subject premises on or before 31.10.2026 and shall pay use and occupation The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. charges @ Rs. 6,500/- per month from the date of impugned judgment i.e. 29.03.2025 till he vacates the property.
3. Let an affidavit of undertaking to the aforesaid effect be placed on record. The said undertaking should also be to the effect that he shall clear all the statutory charges of electricity and water with respect to subject premises till he is in the occupation of the subject property. Let the said undertaking be placed on record before the next date of hearing." 4.
Today, learned counsel appearing on behalf of the petitioner, on instructions from the latter, submits that the subject premises has been vacated and key of the same has been handed over to the respondent/landlord. Today in Court, learned counsel for the respondent/landlord submits that the statutory charges for water and electricity have been paid till date. 5.
In view of the above, learned counsel for the petitioner seeks leave to withdraw the present petition.

Leave granted.

The present petition is dismissed as withdrawn and disposed of accordingly.

Pending application(s), if any, also stand disposed of. 9.
Needless to state that in case of any outstanding charges with respect to water and electricity, respondent/landlord will be at liberty to initiate the appropriate proceedings in accordance with law. 10.
