The Petitioner filed a complaint on 29th November, 2023 alleging that on 16th November, 2023, her husband was illegally arrested, detained, and physically assaulted by police officials, with allegations specifically involving the DCP Central, Shri Sanjay Sain, and the SHO of Police Station Chandni Mahal, Central District.

The grievance of the Petitioner is that despite lodging the said complaint and sending subsequent reminders, no action has been taken thereon. However, at the outset, Mr. M. Sufian Siddiqui, counsel for the Petitioner, states that he would like to restrict his prayers at this stage to a direction to the State to have conduct an enquiry into the complaint by an officer senior to the DCP, since the allegations are directed against the DCP himself. He reserves the Petitioner's right to process other reliefs, should the need arises.

Per Contra, Mr. Sanjeev Bhandari, ASC for the State, submits that the Petitioner's complaint is only an afterthought and that a detailed enquiry has already been conducted wherein no substance was found. 5.
However, on a pointed query by the Court, Mr. Bhandari fairly acknowledges that the enquiry in question was conducted by an officer junior in rank to the DCP.

In view thereof, and without entering into the merits of the case, considering the limited nature of relief presently pressed by the Petitioner, this Court deems it appropriate to direct that the complaint of the Petitioner be enquired into by the Joint Commissioner, Central. 7.
It is clarified that the directions issued herein shall not be construed as this Court's expression of any opinion on the merits of the case or as acceptance of the allegations made by the Petitioner. All rights and contentions of the parties remain open. The directions are being issued solely in the interest of justice and fairness, given that the officer against whom the complaint is made holds the rank of DCP. 8.
It is further directed that the aforesaid exercise be undertaken in a time-bound manner, and the outcome of the enquiry on the said complaint be duly communicated to the Petitioner.
