A Petition under Article 226 of Constitution of India read with Section 482 Cr.P.C has been filed on behalf of the petitioner for quashing of FIR No.0642/2020 under Section 420/468/467/471/120B IPC registered at Police Station Mohan Garden.

Briefly stated, the respondent No.2 had purchased a property from the petitioner on 17.09.2018, but the petitioner had forged the title documents to cheat the respondent No.2. Subsequently, the respondent No.2 got an FIR registered against the petitioner under Section 420/468/467/471/120B IPC at Police Station Mohan Garden.

petitioner and respondent No.2 have settled their dispute vide Settlement Deed dated 07.11.2023. It is submitted that the Settlement has been arrived at between the parties without any force, pressure or coercion and that the parties undertake to abide by the terms of the Settlement dated 07.11.2023. It is submitted that accordingly the present petition for quashing of FIR has been filed by the petitioner.

The affidavits of petitioner and respondent No.2 are annexed along with the Petition. It is submitted that one accused Shri Prem Singh had died on 21.09.2020 and the fact has been duly verified by the Sarpanch. Therefore, the Petition be quashed. 4.

The complainant/respondent No.2 is present in the Court and submits that the matter stands settled with the petitioner vide Settlement Deed dated 07.11.2023 and the respondent No.2 has no objection if the FIR is quashed against the petitioner on account of the settlement arrived at between them. 5.

The parties are present before this Court in-person today, and have been identified by their counsels and Investigating Officer concerned. 6.

In view of the submissions made, the Petition is allowed.

Accordingly, the FIR bearing No.0642/2020 registered at Police Station Mohan Garden, for offences punishable under Sections 420/468/467/471/120B of the Indian Penal Code, 1860 with all the subsequent proceedings is hereby quashed qua the petitioner. 7.

The Petition stands disposed of.
