Learned counsel for the petitioner states that since taking cognizance of the charge-sheet filed the petitioner has been issued a summoning order because there was no stay of proceedings in the instant petition, the petitioner seeks leave to withdraw the petition with right reserved to challenge the summoning order.

Needless to state, in the instant petition the challenge is to the FIR. Challenge to the summoning order would be premised on the basis of the material before the learned Trial Judge, scope of the petition if at all filed would be premised on entirely different grounds i.e. there being no material to take cognizance of the charge-sheet and issue summons. 3.

Granting the liberty as prayed for, Crl.M.C. 1342/2013 & Crl.M.A. 4212/2013 are dismissed as not pressed.
