Learned counsel for the respondents appears on advance notice. 2.

Learned counsel for petitioner submits that with respect to the subsequent default, petitioner has already filed one execution petition which is now listed before the learned Principal Judge, Family Court on 09.01.2025. 3.

Learned counsel for the petitioner, at the moment, simply requests that respondent be, at least, asked to give undertaking that he would appear in those proceedings before the learned Executing Court on the said date. 4.

Learned counsel for respondent, though, submits that she is not aware about filing of any execution petition but as informed by the learned counsel for petitioner during the course of the hearing, she would instruct the respondent to appear before the learned Executing Court on said date i.e. 09.01.2025.

Learned counsel for petitioner submits that in view of the assurance given by learned counsel for respondent, petitioner, at the moment, is not desirous in pursuing with her present petition and be granted liberty to file petition again, if situation so arises.

In view of aforesaid, present petition is disposed of as not pressed. 8.

Liberty, as prayed, is given.

Needless to say, the above order is without prejudice to the rights and contentions of the parties.
