O R D E R

Counsel for respondent states that they have already issued a letter dated 26th March 2025, stating that the school is hereby handed over to the Management of petitioner/Society, only subject to the direction, that necessary repairs and renovations have to be completed within six months. 2.

DOE had, therefore, requested the Management to submit a compliance certificate in this regard, to DDE (Zone IV), and for the DDE to inspect the school, during and after, completion of necessary repairs and renovation.

It was also stated, that till the necessary repairs and renovation is not complete, the students shall be studying in the same school that they have been transferred to, i.e. GGSSS, Gokalpur Village (School ID- 1104021) and GBSSS, Gokalpur Village (School ID- 1104004). The DOE reserved the right to inspect the repairs and renovation at any point of time and have an oversight in that regard.

Another communication was issued on 18th April 2025, as per counsel for petitioner, which also reiterated the same and sought the Management to submit a compliance certificate relating to the site conditions and readiness. 5.

The date & time of inspection had also been notified as 19th April 2025 at 03:30 P.M. The renovation work was to be completed within a period of six months from the date of handing over. 6.

For the respondent and other authorities to ensure that the school is in perfect condition to allow the students to be invited back to the school and continue their education, this process of renovation/repairs, ensuring compliance through oversight and inspection shall be carried on and the petitioner shall duly co-operate in the same. 7.

As regards the orders passed by this Court on 2nd February 2024 in W.P.(C) 9748/2018, the same have already been complied with, in that, the management of the School has been handed over; the only caveat was relating to the renovation and repairs, for which, the above facts and circumstances will have to be taken into account. 8.

Accordingly, the petition is disposed of.

Needless to say, it is the respondent/DOE's duty to ensure to keep complete oversight on the habitability and structural safety of the School before the students are reverted back to the premises.
